By accessing or using AgencyKit (the "Service"), operated by AgencyKit ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance.
2. Description of Service
AgencyKit is a SaaS platform designed for freelancers and agencies to manage their business operations, including:
- Client relationship management (CRM)
- Proposal creation and tracking
- Contract management and e-signatures
- Invoice generation and payment collection
- Time tracking and billing
- Payment gateway integrations (Stripe, PayPal, Paymob)
3. Account Registration
- You must be at least 18 years old to use AgencyKit
- You are responsible for maintaining the security of your account and password
- One license key is valid for one account, sharing is not permitted
- You must provide accurate, current, and complete information
- You are responsible for all activity that occurs under your account
- Notify us immediately at support@agencykit.tech if you suspect unauthorized access
4. License and Usage
- AgencyKit grants you a personal, non-transferable license to use the Service
- For personal and business use only, commercial resale is prohibited
- You may not redistribute, sublicense, or resell your access
- You may not attempt to reverse engineer, decompile, or extract source code
- Your subscription grants access to the features of your chosen plan tier, including all updates to that tier, for as long as your subscription is active
5. Free Trial
New accounts receive a 14-day free trial with full access to Agency plan features. No credit card is required to start your trial.

6. Payments and Refunds
- AgencyKit is a subscription billed monthly or annually, per account
- Subscriptions renew automatically until cancelled; you can cancel anytime to stop future charges
- Payments are processed securely by our payment provider, Lemon Squeezy

7. User Data
- You own all data you create within AgencyKit (clients, invoices, contracts, etc.)
- We process your data solely on your behalf to provide the Service
- We do not sell your data to third parties
- You can export your data at any time from the platform
- Upon account deletion, your data is removed within 30 days
8. Prohibited Uses
You agree not to use AgencyKit to:
- Send unsolicited bulk email (spam) to your clients or third parties
- Store, transmit, or process illegal content
- Attempt to hack, exploit, or disrupt the Service or its infrastructure
- Engage in money laundering or any fraudulent financial activity
- Impersonate any person or entity
- Violate any applicable local, national, or international laws
9. Service Availability
- We aim for 99.9% uptime and strive to minimize disruptions
- Planned maintenance will be announced with at least 24 hours' notice where possible
- We are not liable for downtime caused by factors beyond our control (force majeure, third-party services, etc.)
10. Termination
- You may cancel your account at any time
- We reserve the right to suspend or terminate accounts that violate these Terms
- Upon termination, you should export any data you need beforehand
- Accounts that violate these Terms may be suspended or terminated without refund
11. Limitation of Liability
To the maximum extent permitted by law, AgencyKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Our maximum total liability to you for any claim arising from your use of the Service shall not exceed the total amount you paid us in the 12 months preceding the claim.
12. Governing Law
These Terms of Service are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation, and if necessary, through binding arbitration or courts of competent jurisdiction.
